Food hygiene law of the People's Republic of China
Chapter one
General provisions
Article 1
In order to guarantee the food hygiene, prevent the food pollution and danger to the human body of adverse factor, ensure the people to be healthy, strengthen people's physique, make this law.
Article 2
The country implements the supervisory system of the food hygiene.
Article 3
The health authorities of the State Council are in charge of the supervision and management of national food hygiene.
The related departments of the State Council are responsible for the food hygiene management within the scope of one's own respective functions and responsibilities.
Article 4
Engaged in the management of food production in the field of the People's Republic of Chinaing, must all observe this law.
This law is suitable for all food, food additive, food container, packing materials and tool, apparatus, detergent, disinfectant for food; Also suitable for the production management places, facilities and relevant environments of the food.
Article 5
The country encourages and protects the social supervision to the food hygiene of public organization and individual.
To the behavior of violating this law, anyone has the right to inform against and charge.
Chapter two
Hygiene of the food
Article 6
Food should nonpoisonous harmless, accord with, should have nutrition require, have sensory properties such as corresponding colour, fragrance and taste,etc..
Article 7
Specialize in infant and pre-school children's principle and supplementary foods, must accord with the nutrition that the health authorities of the State Council make, sanitary standard.
Article 8
The food must accord with the following hygienic requirements while producing and managing the course:
(1) Keep internal and external environment to be neat, adopt, dispel fly, mouse, cockroach, other harmful insect and multiply pair
The measure of one, keep the distance that stipulates with the poisonous, harmful place;
(2) The food produces and manages enterprises in the factory building or place of there should be food raw materials in conformity with product variety, quantity that are dealt with, processed, packed, storedding etc.;
(3) There should be corresponding disinfection, change one's clothes, wash hands and face, daylighting, illumination, ventilates, antiseptic, dustproof, fly-proof, protection against rodents, washes, sewage discharge, facility that preserved the rubbish and offal;
(4) Device layout and technological process should be rational, prevent foods to be processed and ready-to-eat foods, raw materials and finished product cross contamination, the food can't be exposed to toxicant, filth;
(5) Tableware, kitchenware and container to hold direct people's food, must clean, sterilize before using, cooking utensil, apparatus must be cleaned after using, keep clean;
(6) Store, transport and load and unload the container packaging, tool, apparatus and string of the food
One must be safe, harmless, keep clean, prevent the food pollution;
(7) There should be inner wrapping or use the nonpoisonous, clean packing materials in the food entering the mouth directly;
(8) The food should often keep the personal hygiene while producing and managing personnel, while producing, selling the food, must clean hands, wear clean job clothing, cap; While selling the direct people's food, must use the selling utensil;
(9) Must accord with the drinking water sanitary standard in urban and rural areas of the national regulation with water;
(10) Detergent, disinfectant used should be safe, harmless to the human body.
To the food street peddler and operator's hygienic requirements while the food produce and manage of food of country trade in urban and rural areas, regulated specifically according to this law by the standing committee of people's congress of province, autonomous region and municipality directly under the Central Government.
Article 9
It is forbidden to produce and manage the following food:
(1) It is unusual to be putrid and deteriorated, spoiled by rancid oil or fat, go mouldy, infested, contaminated, is mixed with foreign matter or other sensory properties, may be harmful to health;
(2) Includes the poisonous, harmful substance or polluting by the poisonous, harmful substance, may be harmful to health;
(3) Contain pathogenic parasite, microorganism, or the microbial toxin content exceeds the country to limit the standard one;
(4) Have not been examined meat and products not up to the standards by veterinarian's hygiene;
(5) Die of illness, poison the birds, domestic animal, beast, aquatic products animal with unidentified cause of the death,etc. and products to death;
(6) It doesn't cause pollution clean that the container packs the contaminated, serious damage or means of transport;
(7) Adulterate, mix, forge, influence the nutrition, hygiene;
(8) Ones that process the non-food raw material, add the non-food chemical material or regard the non-food stuff as food;
(9) Exceed quality guarantee period;
(10) For the special requirement of preventing disease etc., the health authorities or the special regulations of people's government in the province, autonomous region and municipality directly under the Central Government of the State Council forbade selling;
(11) Containing additive used without the permission of health authority of the State Council or residues of pesticides stipulates tolerance over the country;
(12) Other ones that do not accord with food sanitary standard and hygienic requirements.
